Privacy Policy

This Privacy Policy is part of and works with our Terms & Conditions. All defined terms not specifically defined herein shall have the definition as described in our Terms & Conditions.

This Privacy Policy describes how your personally identifiable information, such as your name, address, email, and credit card and other financial account information ("Personal Information"), is collected, used, and shared when you visit, make a purchase from or use the Services offered on www.joymind.com (the "Site"). The Site is owned and operated by Therapacific LLC dba Joymind ("Joymind", "Company", "we", "our", or "us").

Joymind is committed to treating the Personal Information shared with us by our Site Users and Joymind Clients with care and respect.

California Residents: our privacy practices comply with the California Consumer Privacy Act (CCPA) of 2018 and as amended by the California Privacy Rights Act (CPRA) of 2020. Refer to Section 6 below for additional information.

Your use of the Site and by providing Personal Information to us through any means, including, but not limited to, via email, telephone or in person, and by engaging in the use of our Services, you are expressing your unqualified acceptance and consent to policies and procedures as set forth in this Privacy Policy.

1. GENERAL

Your access to and use of the Site, and your continued access and use of the Site, make you a Site User. If you procure Services (as that term is defined in the Terms & Conditions) from us, you are a Joymind Client. In both instances, whether you are only a Site User or both a Site User and a Joymind Client (in both instances sometimes alternatively and collectively referred to herein as "you" and "your"), this Privacy Policy sets forth how your Personal Information is collected, used and shared by the Company.

Children: The Site and the Services offered by Joymind are not intended for use by or directed to children. The Company has no intention of collecting personally identifiable information from individuals under thirteen (13) years of age. Where appropriate, we will specifically instruct children NOT to provide such information to us. If a child has provided us with personally identifiable information, we ask that a parent or guardian of the child contact us at support@joymind.com or (888) 232-9127 to request that this information be deleted immediately from our records. We will use reasonable efforts to delete the child's information from our existing files. This Privacy Policy applies to the United States and is governed by the laws of United States applicable therein.

2. PERSONAL INFORMATION WE COLLECT

When you visit the Site, we automatically collect certain information about your device, including information about your web browser, IP address, time zone, and some of the cookies that are installed on your device. Additionally, as you browse the Site, we collect information about the individual web pages or service offerings that you view, what websites or search terms referred you to the Site, and information about how you interact with the Site. We refer to this automatically-collected information as "Device Information".

We collect Device Information using the following technologies:

– "Cookies" are data files that are placed on your device or computer and often include an anonymous unique identifier. For more information about cookies, and how to disable cookies, visit http://www.allaboutcookies.org.

– "Log files" track actions occurring on the Site, and collect data including your IP address, browser type, Internet service provider, referring/exit pages, and date/time stamps.

– "Web beacons", "tags", and "pixels" are electronic files used to record information about how you browse the Site.

Additionally when you make a purchase or attempt to make a purchase through the Site, and when you engage in our Services, we collect certain information from you, including your name, billing address, shipping address, payment information (including credit card numbers and other financial related information), social security number, email address, and phone number. As related to the Services, in order to provide you with the Services we may also collect information related to health and physical well-being, race, gender, sexual orientation, religion, educational background, employment history and inferences (such as preferences, abilities, traits, characteristics and predispositions) drawn from such information. We refer to this information collectively as "Order and Services Information".

When we talk about "Personal Information" in this Privacy Policy, we are talking both about Device Information and Order and Services Information.

3. HOW DO WE USE YOUR PERSONAL INFORMATION?

We use the Order and Services Information that you give to us generally to fulfill any orders placed through the Site (including processing your payment information, arranging for scheduling of Services, and providing you with invoices and/or order confirmations). Additionally, we use this Order and Services Information to:

  • Provide the Services to you that you request from us and engage in Sessions with you;
  • Communicate with you about our Services, our products, and to keep you informed about and conduct Sessions you schedule with us;
  • To notify you of changes to our Services, Terms & Conditions or Privacy Policy;
  • To comply with applicable laws and regulations;
  • For training purposes, quality assurance and to record portions of the Services that are provided to you;
  • Screen our orders for potential risk or fraud and make inquiries about you for credit reference purposes; and
  • When in line with the preferences you have shared with us, provide you with information or advertising relating to our products or services.

We use the Device Information that we collect to help us screen for potential risk and fraud (in particular, your IP address), and more generally to improve, optimize, test and troubleshoot our Site and for internal operations, including testing, research, statistical and survey analyses (for example, by generating analytics about how our customers browse and interact with the Site, to provide targeted advertising and marketing services, and to assess the success of our marketing and advertising campaigns).

4. SHARING YOUR PERSONAL INFORMATION

Joymind does not sell your Personal Information to third parties. To provide the best experience for Site Users and Joymind Client we share your Personal Information with third parties to help us use your Personal Information, as described above. You can also opt-out of Google Analytics here: https://tools.google.com/dlpage/gaoptout.

You agree that by using the Site and Services you confirm that we have the right to share your Personal Information for the purposes stated herein, including, but not limited to, for business purposes related to sales, advertising and marketing, cloud storage services, website analytics and contractual performance.

Finally, we may also share your Personal Information to comply with applicable laws and regulations, to respond to a subpoena, search warrant or other lawful request for information we receive, or to otherwise protect our rights.

5. BEHAVIORAL ADVERTISING

As described above, we use your Personal Information to provide you with targeted advertisements or marketing communications we believe may be of interest to you. Do not track

Please note that we do not alter our Site's data collection and use practices when we see a Do Not Track signal from your browser.

6. GOOGLE API SERVICES USER DATA POLICY DISCLOSURE

Joymind use and transfer to any other app of information received from Google APIs will adhere to Google API Services User Data Policy, including the Limited Use requirements.

How we use your Google Calendar data:

  • Accessing Calendar List: We use the calendar.calendarlist.readonly scope to allow specialists to select which of their Google calendars they wish to sync with Joymind.
  • Reading Events: We use the calendar.events.readonly scope to identify busy time slots in the specialist's personal calendar. This information is used solely to block corresponding time slots in the Joymind scheduling system to prevent double-booking.
  • Creating Events: We use the calendar.app.created scope to create and manage a dedicated "Joymind" calendar within the user's Google account, where we sync appointments booked through our platform.

Data Privacy for Google Users:

  • We do not share your Google user data with third parties for advertising or marketing purposes.
  • We do not use your Google Calendar data to build user profiles or for any purpose other than scheduling and preventing booking conflicts.
